Understanding Title IX: New Brief Helps Educators Navigate Student Protections
A newly released policy brief from scholars at the University of Wisconsin–Madison and GSAFE offers guidance for Wisconsin educators, parents, students, and advocates navigating the shifting legal landscape surrounding Title IX and transgender student protections. Authored by Maggie L. Paino, J.D., and Dr. Mollie T. McQuillan, and in collaboration with Brian Juchems, Senior Director of Education and Policy at GSAFE, the brief outlines longstanding civil rights protections for LGBTQ+ students in K–12 schools.
Title IX of the Education Amendments Act of 1972 prohibits sex-based discrimination in federally funded educational programs. Historically, this law has been a cornerstone for advancing gender equity and protecting LGBTQ+ students. However, multiple recent federal executive orders—notably, Executive Orders 14168 and 14201—seek to redefine “sex” to exclude gender identity and have directed federal agencies to rescind funding from schools that support trans-inclusive policies.
After the Biden Administration underwent a lengthy process to produce Title IX regulations, the U.S. Department of Education reverted to 2020 Title IX regulations in early 2025, removing explicit protections for LGBTQ+ students. These dramatic federal policy swings have created widespread confusion and fear among school leaders and communities.
“This brief is a critical resource for educators, parents, students, and school boards by providing some essential legal context and actionable strategies that can be adapted to the local context” said Dr. McQuillan.
“These federal rollbacks do not erase the legal protections that courts have upheld for trans students,” said Brian Juchems of GSAFE. “Wisconsin educators can still remain vigilant and proactive in protecting and supporting students in their communities.”
Note: These policy briefs are educational resources and do not constitute legal advice. School districts should consult with their legal counsel for specific policy questions.
